Residential Warranty Terms and Conditions

DCL (as defined below) will provide a 1-year limited warranty on parts and labor, subject to the limited warranty terms outlined below, free of charge with the installation. 3-year and 5- year limited warranties are offered for an additional charge and will coincide with the 1-year limited warranty period. For example, the 3- year limited warranty includes the first year free of charge, plus two additional years. The 5-year limited warranty includes the first year free of charge, plus four additional years. All limited warranty options begin on the date of installation and continue for the period selected above (“Warranty Period”). The selected Warranty Period applies to the initial installation and not subsequent installations. Up to three labor hours are included, at no additional charge, each year during the Warranty Period. Regular labor fees will be charged for any services provided after the initial three hours. All warranty options are subject to the following limited warranty terms:

DCL WARRANTS THAT DURING THE WARRANTY PERIOD, THE PERMANENT LIGHTING INSTALLATION (“PRODUCT”) WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP.

DCL LIMITS THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

DCL’S RESPONSIBILITY FOR DEFECTIVE PRODUCT IS LIMITED TO REPAIR OR REPLACEMENT AS DESCRIBED BELOW. UNLESS EXPRESSLY PROVIDED HEREIN, ANY PURCHASE OF AN EXTENDED WARRANTY PERIOD AS PROVIDED ABOVE IS FINAL AND NON-REFUNDABLE.

WHO MAY USE THIS LIMITED WARRANTY?
Dynamic Celebration Lighting, located at 902 Dickinson Court, Royersford, PA 19468, ("DCL") extends this limited warranty to the consumer who originally purchased the Product ("You"). In the event of a change of ownership by DCL or You, this limited warranty further extends to any subsequent owner or other transferee of the Product.

WHAT DOES THIS LIMITED WARRANTY COVER? This limited warranty covers defects in materials and workmanship of the Product for the Warranty Period. The Warranty Period shall not be extended by DCL’s repair or replacement of the Product. DCL may change the availability and terms of this limited warranty at its discretion, but any changes will not be retroactive. During the Warranty Period, all manufacturer warranties shall be part of and processed in accordance with this limited warranty, and shall not be additional to this limited warranty.

WHAT DOES THIS LIMITED WARRANTY NOT COVER? This limited warranty does not cover any damage due to: (a) misuse, abuse, improper or unauthorized repairs; (b) acts of God, or other events beyond DCL’s control; (c) tampering or system adjustments, including removal of the system, by anyone other than DCL; (d) failure to follow the Product instructions or to perform preventive maintenance; (e) modifications; or (f) normal wear and tear.

This limited warranty does not include any technical support beyond that provided by DCL during the initial installation. For the purpose of clarity, the limited warranty does not cover, nor is DCL responsible for, technical support regarding Your usage of the application that controls the lighting on Your electronic device (the “App”) (e.g., navigating the App, the App’s compatibility with Your device, etc.). In no event will DCL be liable for the performance of, or damages resulting from, the App

WHAT ARE YOUR REMEDIES UNDER THIS LIMITED WARRANTY? With respect to any defective Product during the Warranty Period, DCL will, in its sole discretion, repair or replace such Product (or the defective part) free of charge.

HOW DO YOU OBTAIN WARRANTY SERVICE?

LIMITATION OF LIABILITY:
THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND DCL’S ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. DCL’S LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL DCL UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

In the event that DCL determines in its reasonable judgment that repair or replacement of a defective Product is not feasible, DCL may in its discretion provide a substitute Product that is reasonably equivalent to the original Product, or DCL may refund the purchase price of the Product.

WHAT CAN YOU DO IN CASE OF A DISPUTE WITH US?
YOU AND DCL ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION. ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND DCL ARISING FROM OR RELATING IN ANY WAY TO YOUR PURCHASE OF PRODUCTS, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.

The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with the Consumer Arbitration Rules (the "AAA Rules") then in effect, except as modified by this Section. The Federal Arbitration Act will govern the interpretation and enforcement of this Section. The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or this limited warranty is void, voidable or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.
